Watermans warn that significant changes to the new Enterprise and Regulatory Reform Act 2013 could affect the safety of people in the workplace. Until October 2013, it was taken for granted that employers have a duty of care towards employees. However, the new rules place the onus on employees to prove than an employer is negligent or in breach of duty of care. The company believe that the new legislation could potentially see safety standards fall while the cost of litigation for employees increases
along with a possible rise in the number working days lost through
work-related accidents and ill-health.
